She said I didn't need to start a business, but a video on YouTube said owning an LLC will protect your money from lawsuits, and other things that can go wrong.

Yes, an LLC will protect you against lawsuits and such - but it's a question of size and income, really.

Do you make enough money to cover the cost of an LLC in addition to editing, formatting and covers?

How high is the actual risk of a law suit as "simple author"?

These are factors to weigh.

Yes, once authors get successful, most of them start an LLC. And it makes sense. If I were to make ~2k from my books per year, I'd consider it. Right now, it's not worth it.

I've been sued twice by a distant cousin. Kind of has me in self-protection mode. Plus, there was mention that Amazon owned rights, like a traditional publisher, if I had them listed as publisher, and didn't have a business name to put my works into. *shrugs*

I'm very sorry you got sued twice. emoticon

Nope, Amazon only owns those works it publishes in its imprints, and that's taken care of through contracts with the authors.

If I upload a file for a book, Amazon is the distributor, they do not gain copyright because of the upload. Nor do any other distributors like Draft2Digital or Smashwords.

What you mean might be that they assign an ASIN to an ebook - an Amazon identification number which does tell people that the ebook has been published through Amazon, and some people confuse that with a traditional publisher. Amazon does that that unless you buy and assign an ISBN to your ebook yourself.

Thank you.

So, then the article I read must have been to discourage using Amazon as a publisher, and I mistook it for uploading and selling. And I'll remember to buy the ISBNs myself so I can use it on all sites.

Thanks for the info.
